( 1 ) THIS Writ Appeal has been filed against the impugned judgment dated 2. 9. 2003 by the learned Single Judge, by which he has dismissed the Writ Petition.

( 2 ) HEARD learned Counsel for the parties and perused the record.

( 3 ) THE facts of the case have been set out in detail in the impugned judgment of the learned Single Judge and hence we are not repeating the same except where necessary.

( 4 ) THE Respondent was a workman under the petitioner. He raised an industrial dispute, which was referred to the Industrial Tribunal-I, Karkardooma, delhi. The Reference Order under Section 10 (1) of Industrial Disputes Act states:"whether the termination of service of Sh. Ram Rattan Sharma by the management is illegal and unjustified and if so to what relief is he entitled and what directions are necessary in this respect. "

( 5 ) THEREAFTER an inquiry was held in which the respondent was found guilty and dismissed from service. The petitioner filed an approval application under section 33 (2) (b) of Industrial Disputes Act, while the workman raised an industrial dispute which was referred under Section 10 against the termination of his service (as already stated
