1. By this petition filed under Section 482 of Code of Criminal Procedure, 1973 the petitioner seeks to challenge the impugned order dated 12.10.2010 passed by the Court of Additional Sessions Judge, Delhi whereby the learned Additional Sessions Judge dismissed the application filed by the petitioner accused under Section 6, 7, 18 and 49 of the Juvenile Justice (Care and Protection of Children) Act, 2000 for sending his case to the Juvenile Justice Board.
2. The petitioner, who has claimed himself to be a juvenile at the time of commission of the alleged offence, is accused in FIR bearing No. 78/2009 registered against him along with the co-accused persons under Sections 365/302 IPC. This FIR was registered at the instance of one Mr.Durgapal, brother of deceased Arun Pal. The police has also completed its investigation and charge-sheet has been filed against the accused persons for the offences punishable under Section 365/302/120B/34 IPC.
