P.C. to seek transfer of the Complaint Case Nos.818, 819, 820, 821, 822, 827, 828 & 829/2013, all under Section 138 of the Negotiable Instruments Act, 1881 (NI Act) pending trial in the Court of Ms. Deepti Devesh, learned M.M., Karkardooma Courts, Delhi, titled “Gulshan Sethi Vs. Naveen Malhotra”, to the Court of Ms. Purva Sareen, Learned M.M., South, Saket, where C.C. No.54/1/2013 (subsequently converted to First Information Report (FIR) No.485/2014, Police Station – Safdarjung Enclave, New Delhi) titled Naveen Malhotra Vs. Gulshan Sethi & Others, is pending.
4. The facts in brief are that the aforesaid complaint cases under Section 138 of the NI Act have been preferred by Gulshan Sethi against the petitioner herein as the accused in respect of several cheques allegedly issued by the petitioner, which have been dishonoured upon presentation. The petitioner has also preferred a complaint under Section 200 read with Section 156(3) Cr. P
