2013 Supreme(Del) 2404

DELHI HIGH COURT
Valmiki J.Mehta, J.
S.S. Dubey [Lt. Col. (Retd.)] - Appellant
Versus
Director of Education & Ors. - Resopndent
W.P. (C) No. 110 of 2008
Decided On : 07-11-2013

Advocates:
For the Petitioner:Mr. H.K. Chaturvedi, Advocate.
For the Respondent No. 1:Ms. Sana Ansari, Advocate.
For the Respondent Nos. 2 & 3:Ms. Parul Babbar, Advocate.

An employee receiving pension is entitled to only one gratuity, which is retirement gratuity, not both service gratuity and retirement gratuity.

Headnote:

Gratuity - CCS Pension Rules - Rule 49, Rule 50

Fact of the Case:

The petitioner seeks payment of both service gratuity and retirement gratuity as provided in Rules 49 and 50 of the CCS (Pension) Rules, 1972. The petitioner had prior military service and is receiving pension for it.

Finding of the Court:

The court held that the petitioner is entitled to only one gratuity, which is retirement gratuity, and not both service gratuity and retirement gratuity. The circular suggesting the payment of both gratuities is illegal if the employee is also receiving pension.

Issues: The main issue was whether the petitioner is entitled to both service gratuity and retirement gratuity while receiving pension for prior military service.

Ratio Decidendi: The court interpreted the CCS Pension Rules and held that pension and service gratuity are alternative to each other, and an employee receiving pension is entitled to only retirement gratuity, not both gratuities.

Final Decision: The court dismissed the writ petition, stating that no relief under CCS (Pension) Rules can be granted to the petitioner, as the school is a private unaided school to which the Payment of Gratuity Act, 1972 applies, not the CCS(Pension) Rules.

JUDGMENT :

Valmiki J. Mehta, J.

1. The petitioner by means of this writ petition seeks the relief of payment of both the service gratuity and the retirement gratuity as provided in Rules 49 and 50 of the CCS (Pension) Rules, 1972. Rules 49 and 50 of the CCS Pension Rules are therefore required to be interpreted, and the same read as under:-
