JUDGMENT :

1. The present petition under Section 482 Cr.P.C. has been filed by the petitioner, namely, Ramesh Kumar for quashing of FIR No. 371/2009 dated 18.10.2009, under Sections 279/304A IPC registered at Police Station Najafgarh on the basis of the compromise deed arrived at between the petitioner and the respondent no. 2, namely, Kamla Devi on 07.09.2015.

2. Learned Additional Public Prosecutor for respondent-State submitted that the respondent no.2, present in the Court has been identified to be the victim in the FIR in question by ASI Tej Ram.

3. The factual matrix of the present case is that the FIR in question was lodged by the complainant, namely, SI Shri Kirshan on the allegation that on 17.10.2009, the DD No. 37B about an accident was handed over to him upon which he reached at the spot of the accident where no eye witness was found and he came to know that the injured is taken to RTRM hospital. Sachin Dagar informed the complainant that a cyclist was hit by an unknown motorcycle, due to which he made the PCR call. In the unfortunate incident, the husband of the respondent no.2 expired on 17.10.2009. On the basis of the investigation, the FIR in question was
