1. The present petition under Section 482 Cr.P.C. has been filed by the petitioners, namely, Sh. Devender Bansal and Sh. Mukesh Sahu for quashing of FIR No. 99/2004 dated 18.03.2004, under Section 63 Copyright Act registered at Police Station Adarsh Nagar on the basis of Compromise Deed executed between the petitioners and respondent no. 2, namely, Sh. Ravi Saxena, authorized representative of M/s D. S. Group, on 03.03.2016.

2. Learned Additional Public Prosecutor for respondent-State submitted that the respondent no. 2 present in the Court has been identified to be the complainant/first informant by his counsel.

3. The factual matrix of the present case is that M/s D.S. Group is one of the leading manufacturers and distributer of tobacco goods and the complainant is the authorized signatory of M/s D.S. Group. It was informed to the officials of M/s D.S. Group that certain persons were manufacturing and/or selling and/or offering for sale and/or otherwise dealing in Baba, Tulsi and Rajnigandha items bearing the false description of copyright, thereby confusing and deceiving the customers and trade marketers.
