In view of the judgment of the Division Bench in DDA vs. Durga Construction, 2013 (139) DRJ 133 (Del) (DB) and the averments made in the application, the delay in refiling is condoned.

The application is disposed of

O.M.P. (COMM) No. 320/2017

1. The petitioner by way of the present petition under Section 34 of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as the Act) impugns the award dated 16th February, 2017.

2. By award dated 16th February, 2017 the Arbitrator has awarded as under:-
