1. The present appeal under Clause 10 of the Letters Patent Appeal assails the judgment dated 09.09.2016, rendered by a learned Single Judge of this court in WP(C) No. 2732/2016 titled as “Sachin Kumar vs. UOI & Ors.”, whereby the said petition was rejected as being devoid of merit.
2. This is admittedly the second round of litigation between the parties based on the same subject matter.
3. On 09.01.2012, the appellant/Sachin Kumar tendered his resignation as Deputy Manager (Kuwait) to respondent No. 2/Telecommunication Consultants India Limited (hereinafter referred to as “TCIL”), with immediate effect. It would be profitable to extract the said communication annexed as Annexure B (Colly), which forms the genesis of the present dispute in full. The said communication dated 09.01.2012 reads as follows:-
