JUDGMENT :

SANGITA DHINGRA SEHGAL, J.

1. The present petition has been filed under Section 439 of the Code of Criminal Procedure, 1973 (hereinafter referred Cr.P.C.) for grant of regular bail in case FIR No. 964/2017 under Sections 304-B/498-A/302/34 of the Indian Penal Code, 1860 (hereinafter referred to as IPC) registered at Police Station-Vasant Vihar.

2. The brief background of the present case is that, on 25.08.2017, notice was issued on the application seeking grant of regular bail filed by the petitioner. It was prayed on behalf of the petitioner that as the medical condition of the petitioner was quite serious, his medical record be called for.

This Court vide order dated 25.08.2017 called for the medical report of the petitioner from the concerned Jail Superintendent for the next date of hearing i.e. 07.09.2017.

3. On 07.09.2017, medical report of the petitioner was filed on behalf of the State wherein it was stated as under:-

“The inmate was referred to IHBAS Hospital on 19.08.2017 whereby the inmates was inter-alia advised to get admitted in IHBAS Hospital if require, with proper reception order.

On 21.08.2017, the inmate was referred to Emergency Department at DDU Hospital whe
