1. The petitioners grievance is that the documents in response to the e-tender of the Govt. of NCT of Delhi for procurement of Ayurvedic and Unani medicine could not be uploaded in the website www.govtprocurement.delhi.gov.in. In support of this contention, it has placed on record photocopies of the screenshots indicating that though repeated attempts to freeze and therefore, upload its bid were made, the website was not accepting it, and consequently, the petitioner was timed out at 1:00 p.m on 12.10.2018, which was the stipulated time for close of bidding.

2. The Government of NCT of Delhi is represented and has appeared on advance notice. The relevant file relating to the tender procurement as well as appraisal of the petitioners bid – to the extent that it did not relate to electronic/digital submission of documents, has been shown to the Court. Besides uploading documents on the portal in question, every bidder had to produce the bank guarantee towa
