JUDGMENT :

Rekha Palli, J.

The present writ petition under Articles 226/227 of the Constitution of India assails the order dated 08.09.2015 passed by the Central Administrative Tribunal (hereinafter referred to as 'the Tribunal') in OA No.3369/2013. The Tribunal, vide the impugned order, has allowed the OA filed by the respondent no.1 herein and directed the petitioner to pay the difference of emoluments for the period during which the respondent no. 1 had performed the duties of the higher post of Finance and Accounts Officer.

2. The respondent no.1 (hereinafter referred to as respondent), having joined the petitioner Central Pollution Control Board as an Account Assistant on 24.09.1981, was promoted to the post of Accounts Officer on 20.12.1985. While working at the said post, the respondent, pursuant to an order dated 22.12.2004 issued with the approval of the Chairman of the petitioner, was asked to discharge the duties of the higher post of Finance and Accounts Officer (FAO), which duties he carried out satisfactorily from 22.12.2004 to 21.09.2005.
