The challenge in the present appeals filed by the appellants is to the common judgment on conviction dated 22.04.2016, passed by the Trial Court, in SC no. 102/2013 arising out of FIR No.24/2012, P.S. Swaroop Nagar, whereby the appellants have been held guilty for the offences punishable under Sections 302/326/34 IPC. The appellants have also challenged the order on sentence dated 23.04.2016, whereby all the three appellants were sentenced to:
(i) undergo rigorous imprisonment for life (each) and pay fine of Rs.25,000/- each and in default of payment of fine, to undergo simple imprisonment for a period of 6 months each for the offence punishable u/s 302/34 IPC.
(ii) undergo rigorous imprisonment for a period of 5 years each and pay fine of Rs.10,000/- each and in default of payment of fine, to undergo simple imprisonment for a period of 3 months each for the offence punishable u/s 326/34 IPC.
(iii) Benefit of Section 428 Cr.PC was given to the appellants and it has been directed that all the sentences would run concurrently.
