ORDER

CRL.M.A.6456/2004:

1. This application is filed with a prayer to release the appellant/applicant on his furnishing a personal bond without any surety/sureties as there is no one to stand surety for him.

2. We have heard Mr.Verma who appears for the appellant/applicant as Amicus as also the learned Additional Public Prosecutor.

3. The appellant, Kundan Kumar Singh, has filed the present appeal against the judgment dated 20th August, 2001 and order of sentence dated 21st August, 2001. By order dated 29th October, 2003, this Court suspended the sentence of the appellant on his furnishing a personal bond in the sum of Rs.10,000/- with two sureties of the like amount to the satisfaction of the Trial Court. Despite the fact that the said order was passed on 29th October, 2003, the appellant could not avail of the benefit and was not released as he was unable to furnish the sureties in terms of the order. On 19th December, 2003, on application the order was further modified to the appellant furnishing one surety instead of two sureties.
