Exemption allowed subject to all just exceptions.

Application stands disposed of.

O.M.P.(MISC.)(COMM.) 470/2019

1. Issue notice.

2. Dr. Vikrant Narayan Vasudeva, Advocate, enters appearance on behalf of the respondent and accepts notice.

3. Present petition has been filed under Section 29A(5) of the Arbitration and Conciliation Act, 1996 (`Act') seeking extension of time for passing of the Award.

4. On 14.02.2015, Shri S.R. Pandey (Retd.), ADG, CPWD, was appointed as a Sole Arbitrator to adjudicate the disputes between the parties. The respondent, thereafter, filed a petition under Section 14 and 15 of the Act for termination of the mandate of the learned Arbitrator. Vide order dated 08.03.2018, this Court terminated the mandate of the learned Arbitrator and appointed another Arbitrator.

5. Learned counsels for the parties submit that a period of one year has elapsed on 07.05.2019. By mutual consent, the
