Sethu Lakshmi, Member—This is an appeal filed by the Divisional Manager of Southern Railways and the Station Master of Southern Railway, Thiruvananthapuram against an order dated 5-12-1990, of the Consumer Disputes Redressal District Forum, Ernakulam in O.P. No. TCR/87/90 allowing the Respondent — Complainant Abubaker Haji an amount of Rs. 3684/- by way of compensation. The facts are not disputed. The complainant and five others had booked tickets for travel from Trichur to Mangalore on 16-5-90 in the A.C. Chair Car in the Parasuram Express. They had booked the tickets one week before the day of travel. But no A.C. Coach was attached to the Parasuram Express on the relevant date. According to the Respondent (Complainant) he and the others come to know of the cancellation of the A.C. Chair Car coach only ten minutes before the departure of the train. They obtained full refund of the amount paid by them for reserving tickets for A.C. Chair Car and purchased ordinary second class tickets and travelled in the same train from Trichur up to Shornur.
