GUJARAT HOUSING BOARD – Respondent


ORDER

S.A. Shah, J. — All these complaints are against the Gujarat Housing Board and the State of Gujarat in respect of a Scheme of tenaments floated by the Gujarat Housing Board for the benefit of eligible freedom fighters.

The Complainant No. 32 of 1990 is a registered voluntary consumer Association and the second complainant is one of the applicants to get the tenament. In all other matters, the complainants are applicants who were eligible freedom fighters.

2. Since the complaints are in respect of the same Scheme, against both opponents involving similar issues including the price of the tenaments, with the consent of all the parties, these matters have been consolidated and evidence has been recorded in Complaint No. 32 of 1990 by an order dated March 22,1991.

Thereafter, relevant documentary evidence produced by the parties in other complaints has been treated to have been received and filed in Complaint No. 32 of 1990 for the sake of convenience.

3. Short facts giving rise to these Complaints, inter alia, are as under :-

3.1. That Opposite Party No. l Gujarat Housing Board (GHB for short) is a statutory Body constituted by the State of Gujarat and it carries on its activities of
