NATIONAL CONSUMER DISPUTES
REDRESSAL COMMISSION, NEW DELHI
Hon’ble Mr. Justice V. Balakrishna Eradi, President;
Mrs. A.S. Vijayakar, Member; Dr. A.K. Ghosh, Member;
Mr. Y. Krishan, Member; Dr. Rais Ahmed, Member
M/S. KAILASH CHAND JAIN—Appellant/Complainant
versus
GENERAL ELECTRIC CO. OF INDIA & ANR.—Respondents/Opp. Parties
F.A. No. 15 of 1989—Decided on 7.12.1989

Counsel for the Parties :
For the Appellant : Nemo.
For the Respondent:Mr. Nitya Ramakrishnan & Mr. Ashok Agarwal, Advocates.

ORDER

Mr. Justice V. Balakrishna Eradi, President—The appellant, who has filed this appeal in person, is not present when the appeal is called on for hearing. We have examined the appeal on the merits. It is seen that the purchase of the machinery by the appellant was specifically for the purpose of setting up an oxygen plant for commercial purpose. The appellant is not, therefore, a ‘consumer’ within the meaning of the said expression as defined in the Act. On this short ground, the State Commission should have dismissed the complaint. The order of the State Commission dismissing the complaint on the merits does not, therefore, call for any interference. The appeal is dismissed.

Appeal dismissed.
