Mr. Justice V. Balakrishna Eradi, President — The Counsel for the Respondent has produced before us the order dated 1st of September, 1989 passed by the City Civil Court, Bombay referring the dispute between the Complainant and the Respondent concerning the erection of the lift and the charges claimed by the Respondent herein as against the Complainant to the arbitration of Shri N.L. Bhatia. In the arbitration proceedings, it will be open to the Complainant to raise all his contentions regarding the alleged defective nature of the lift and the claims for compensation that which, according to him, he has in respect of such alleged defects in the lift. In view of the matter being, thus, pending before the Arbitrator appointed by the City Civil Court, Bombay, we are not inclined to enter upon adjudication of this matter by this Commission. Accordingly, this Petition will be dismissed on this limited ground.
Petition dismissed.
