Mr. Justice Y.B. Suryavansi, President—The appellant is aggrieved against the impugned orders awarding the complainant/respondent Dr. Purohit—Rs. 2,000/- as compensation for loss of professional income, Rs. 1,000/- as compensation for mental agony and inconvenience; and Rs. 500/- as costs for attending seven hearings, — total Rs. 3,500/-.
2. It is common ground that Sainik Service Station Petrol Pump is located at Racecourse Road, Gwalior, which supplies petrol. The complainant Dr. Purohit is a Specialist in Orthopaedics, and has a Nursing-Home at Tansen Road, Gwalior. It is not disputed that in between the Sainik Petrol Pump and complainant’s Nursing-Home, there are three other Pumps whereas this Pump is at a far off place on Racecourse Road. Ordinarily, the working hours for supply of petrol at Sainik Pump are from 8.00 a.m. to 7.00 p.m. Admittedly, petrol was not supplied on 11.9.1990 till about 3 or 4 p.m. Why it was not supplied during the usual hours is a matter of dispute, and the versions given by the parties are divergent.
