ORDER

Mr. Justice S.K.M. Lodha, President— Dr. Purushottam Nagar (complainant) has filed this complaint under Sec. 12 read with Sec. 17 (a) (i) of the Consumer Protection Act, 1986 (“the Act” herein) against (1) Zonal Manager, U.C.O. Bank, Bans Park, Jaipur (opposite party No. 1) and (2) Branch Manager, U.C.O. Bank, Tonk Road, Jaipur (opposite party No. 2) before the State Commission on 17-4-1990 praying that the opposite parties may be directed to permit the complainant to operate S.B. Account No. 2427/16 and to restore Rs. 1,71,358/- which were available in the aforesaid account on 8-2-1990. A declaration may be granted that whatever amount has been withdrawing of transferred after 8-2-1990 is illegal. A sum of Rs. 15,000/- was claimed for mental agony, lowering of prestige and for non-operation of the account A sum of Rs. 2,200/- was claimed as costs of the complaint.’’

2. Facts leading to this complaint are these: The complainant has a Savings Bank Account No. 2427/16 with opposite party No. 2. He is entitled to operate the account and withdraw the amount. There was a balance of Rs. 1,71,358/- in the aforesaid account on 8-2-1990. The following cheques — were issued by the comp
