ORDER

Mr. Justice V.S. Kokje, President:—This is an appeal by the Telegraph Department of Union of India against the order of District Forum Sagar directing it to pay Rs. 200/- as compensation for delaying transmission of a telegraphic message and Rs. 100/- as expenses.

2. The respondent Gauri Shankar Chourasia filed his complaint before the District Forum, Sagar alleging that on 11.11.1991, Dayashankar sent a telegraphic message from Rewa to the complainant which was received by the complainant at Sagar on 17.11.1991. According to the message the complainant had to reach Rewa on 13.11.1991 but the telegraphic message itself reached Sagar on 16th and was delivered to the complainant on 17th of November, 1991. According to the non-applicants the telegram was received in Sagar on 16.11.1991. On that date the complainant/addressee of the telegram was not traceable and therefore, the telegram was delivered on the next day i.e. 17th November, 1991.

3. It is contended on behalf of the appellant that the District Forum, Sagar had no jurisdiction to deal with the case as the telegraphic message was only received there and did not emanate from that place. It is submitted on behalf of the appel
