REDRESSAL COMMISSION, JAIPUR
Honble Mr. Justice S.K.M. Lodha, President; Mr. Damodar Thanvi,
Member; Mrs. Saria Khan, Member
DISTRICT TELECOM, ENGINEER—Appellant/Opposite Party
versus
DISTRICT FORUM & ANR.—Respondents
Appeal No. 183 of 1990 — Decided on 22.3.1991

A complaint under the Consumer Protection Act, 1986, cannot be entertained if, on the date the complaint was filed, a suit or application for obtaining relief had become time-barred.

Headnote:

CONSUMER PROTECTION ACT, 1986 - LIMITATION - BAR OF LIMITATION - COMPLAINT FILED AFTER EXPIRY OF LIMITATION PERIOD - NOT MAINTAINABLE.

Fact of the Case:

The complainant deposited Rs. 300/- as a guarantee for local call charges and trunk call charges to become an agent of L.D.P.T. (Long Distance Public Telephone). An agreement was executed on 23.2.1985. The complainant wrote letters for installing the telephone L.D.P.T. but received a reply that it was not feasible to install L.D.P.T. The amount of Rs. 300/- together with interest was returned. The complainant filed a complaint on 18.9.1989, alleging breach of the agreement and seeking compensation of Rs. 4,000/- and installation of L.D.P.T.

Finding of the Court:

The District Forum directed the opposite parties to install a public telephone in the premises of the complainant within a month in accordance with the terms of the agreement and to start its service. The appellant challenged the order.

Issues: 1. Whether the complaint was barred by limitation? 2. Whether the complainant was a consumer within the meaning of Section 2(1)(d) of the Consumer Protection Act, 1986?

Ratio Decidendi: 1. The complaint was filed after the expiry of the limitation period of two years from the date of the alleged breach of the agreement. Therefore, the complaint was barred by limitation. 2. The complainant was not a consumer within the meaning of Section 2(1)(d) of the Consumer Protection Act, 1986, as he was merely appointed as an agent to perform duties under the agreement and was to receive commission for his services.

Final Decision: The appeal was allowed, and the order of the District Forum was set aside. The complaint was dismissed.
