Mr. Justice S.A. Kader, President—This is a complaint by the Tamil Nadu Khadi & Village Industries Board against National Textiles Corporation Limited. The case of the complainant is that he has paid a total sum of Rs. 6,33,000/- including deposits for the supply of 64 Nos. of cards and one blow room line with 2 sketchers. The value comes to Rs. 5,69,200/- and the opposite party is bound to return a sum of Rs. 63,800/-. The complainant claims refund of the sum of Rs. 63,800/- with interest thereon at 18% amounting to Rs. 1,37,808/- and totaling a sum of Rs. 2,01,608/-. The complaint has been posted for admission.

2. The Learned Counsel for the complainant is heard. This is a simple case of excess amount paid by the complainant for the supply of 64 cards and one blow room line. There is no question of any deficiency of service. The proper Forum to recover the amount is Civil Court of competent jurisdiction. The complaint is therefore dismissed.

3. In the result the complaint fails and is dismissed.

Complaint dismissed.
