Mr. Justice S.A. Kader, President—This is a complaint under Sec. 17 read with Sec. 12 of the Consumer Protection Act.
2. The first complainant is the husband and the second complainant is his wife. In the first week of March, 1992 when the complainants were staying at Madras in their son's house, the 2nd complainant vomited blood and was admitted in the second Opp. Party.
Nursing Home for treatment by the first Opp. Party, who had attended on her on previous occasions. The case of the complainant is that from the moment of her admission in the second Opp. Party Nursing Home there was total mis-management to the extent of virtually throwing the second complainant into the jaws of death, because of the negligence and improper medical treatment given to her. Various acts of negligence and deficiency of service are attributed to the first and the second Opp. Parties with which we shall deal while discussing the case in detail. The complainants have therefore come forward with the claim for compensation in the sum of Rs. 1,50,000/-.
