ORDER

Mr. Justice D.R. Vithal Rao, President — The appellant and the learned Counsel for the appellant called out absent. The respondent and the learned Counsel for the respondent were also called out absent.

2. We have called for the records and received. We have perused the order passed by the District Forum, Dharwad.

3. The complainant had sought compensation from the municipal authorities for the injury that he had sustained in a dog-bite on the municipal road in the night.

4. In Sri. A. Srinivasa Murthy v. Chairman, B.D.A. reported in I (1991) CPJ 657, this Commission while considering the similar circumstances of the case, held as under:

“A victim of dog bite is not a Consumer within the meaning of the Consumer Protection Act, 1986.”

5. Having regard to this principle, the finding recorded by the District Forum, does not suffer from any infirmity. Hence, the appeal fails and it is dismissed. No costs.

Appeal dismissed without costs.
