Mr. Justice S.C. Mohapatra, President — Deficiency in banking service is grievance of the complainant.
2. Mr. Narendra Mohapatra is the Secretary of the complainant society. It had an account in Keonjhar Branch of Opposite Party. While account was being operated by Mr. Narendra Mohapatra, conflicting documents were received by the Keonjhar Branch of Opposite Party. In such circumstances, another Society was registered at Rairangpur-with Mr. Narendra Mohapatra as Secretary in the same name for which the Opposite Party-Bank becoming doubtful about the same and has withheld payment. This is conversion of the Bank before us.
3. We do not find any unreasonableness in the stand taken by the Bank. However, the Bank should have intimated the fact to Shri Narendra Mohapatra indicating the circumstances under which they have not able to transfer the account to Rairangpur. We direct that the Bank shall intimate such facts to Shri Narendra Mohapatra within two months from today with reasons thereof, so that the Society (Complainant) can get declaration from the competent Civil Court and direction to the Bank for transfer of the account.
4. With the above directions, complaint is disposed of.
