Mr. Justice G.G. Sohani, President—This appeal is directed against the order dated 6.10.1993 passed by the District Consumer Disputes Redressal Forum, Gwalior in Complaint Case No. 1258/92.
2. The appeal arises out of a complaint instituted by the respondent claiming damages on account of accident caused on 31.1.1992 to his Jeep which was insured with the appellant. It was averred that the Jeep was being driven by Satishchandra Jain who held a driving licence from the year 1964 and was never disqualified for holding a licence. The complainant contended that his claim was illegally repudiated by the opponent. Hence he made a complaint.
3. The claim was resisted by the opponent mainly on the ground that on the date of the accident the driving licence of the driver of the Jeep, who was killed in the accident, had expired and that he was not duly qualified to drive the vehicle in question. It was further contended that though the driving licence of the driver had expired on 30.10.1986, yet in the copy of the licence enclosed with the claim form submitted by the complainant it was mentioned that the driving licence of Satishchandra was renewed from 123.1992 to 11.3.1995 although Sati
