Mr. Justice B.S. Yadav, Member—This is an appeal against the order dated 29th January, 1993 passed by the Consumer Disputes Redressal Commission, Tamil Nadu in Complaint No. 136/92 by which the opposite party Nos. 1, 2 and 3 who were Branch Manager, Regional Manager of the State Bank of India respectively (now Appellants) and V. Esakki Muthu, peon posted in State Bank of India, Palayankottai respectively were directed to pay Rs. 5,951.30 with interest at the rate of 12% from 24.7.90 till payment and a sum of Rs. 10,000/- as compensation to the complainant. The complaint was filed by the present Respondent No. 1 (hereinafter referred to as complainant).
2. According to the complainant he had deposited a sum of Rs. 55,000/- with the State Bank of India, Palayamkottai under Pass Book No. SSC 181293. He withdrew a sum of Rs. 19,000/- and there was a balance of Rs. 36,000/-. The 3rd opposite party i.e., V. Esakki Muthu was employed as peon with the said Bank and is tenant in the complainant's sister's house. The complainant had handed over the Pass Book to the opposite party No. 3.
