Mr. Justice Navin Chandra Sharma, President—This revision has been filed by the Treasury Officer, Udaipur in his capacity as Member Secretary of the Rajasthan Pensioners’ Medical Fund and the Chairman and some other members of the said Fund against the order of the District Forum, Udaipur dated 4.8.93 whereby the District Forum overruled the preliminary objection raised by the opposite parties-petitioners in Complaint Case No. 183 of 1993 and held that the complainant-respondent was a ‘consumer’ within the meaning assigned to the term by the Consumer Protection Act, 1986 and as such entitled to file the aforesaid complaint case.
2. The Government of Rajasthan had decided to provide medical relief to the State Government pensioners. The State Government, therefore, by Finance Department Notification No. F. (6) FD/Gr. 2/78 dated 19.11.1981 published a scheme called “Rajasthan State Pensioners Medical Concession Scheme” in the Rajasthan Gazette (Extraordinary), Part IV(c) dated 19.11.1981. It was provided in the said scheme that the scheme will be implemented and administered by a Board of Trustees consisting of the Chief Secretary, as Chairman, Finance Secretary, Health Secretary
