Mr. Justice Navin Chandra Sharma, President—We have heard the learned Counsel for the respondent in this appeal. The appellant has not appeared. It may be mentioned that Shri Prahalad Gupta, Accountant of Sophia School was present on 19.5.94 and had notice of today’s date. However, none has appeared today.

2. We have gone through the order of the District Forum. It s clear that the two daughters of complainant-respondent were allowed by the appellants to appear in the annual examination for VIIIth and VIth class respectively on 9.7.90. Their result was declared on the very next day on 10.7.90. An application was filed on their behalf on 11.7.90 for transfer certificate, because their father had been transferred to Pali. The transfer certificate was issued on 12.7.90. In such circumstances, the appellants were not at all justified in charging tuition fee or other fee for the month of July, 1990 from the complainant-respondent. The order of the District Forum is perfectly correct and there is no force in this appeal and the same is hereby dismissed. As the appellant has not appeared, we leave the parties to bear their own costs.

Appeal dismissed.
