Dr. Sunil Kanti Kar, Member—The impugned order dated 3.10.1994 passed by the learned C.D.F. in C.D.F. Case No. 2711 of 1994 has been assailed of by the appellant in the instant appeal. In the said impugned order, it was directed by the learned C.D.F. to provide with electricity to the respondent No.1 from the meter of the appellant immediately after receipt of the order failing which serious penal action would follow and the appellant shall be made liable to make good the loss to the tune of Rs. 20,000/- for any default to comply with the aforesaid order. It is the case of the complainant who is respondent No. 1 and another tenant Smt. Annapurna Dutta who is respondent No. 3 had been jointly enjoying electricity from a meter standing in name of the wife of the appellant. It is further case of the respondents Nos. 1 and 3 that they had been paying electricity charges in moiety share to the appellant/landlord but due to none deposit of the said electricity charges on account of Meter No. 251785, the C.E.S.C.
