Mr. Sada Nand, Member—The complainant a non-resident Indian applied to the Estate Officer, Urban Estates, Punjab on 15.9.1974 for the allotment of a residential plot of 500 sq. yds. at Mohali and deposited a sum of Rs. 1,350/- as earnest money in foreign exchange being 10% of the price of the plot against NRI quota. This application was registered at No. F- 521. In the year 1993 the Department of Housing was merged in the Punjab Housing & Development Board and vide letter dated 8.5.1995 the Board demanded a sum of Rs. 58,650/- from the complainant to complete 10% of the price at revised rate. The complainant deposited that amount by way of Bank Draft on 21.6.1995 in rupees and according to the complainant no objection was raised at the time of receipt of the said Bank Draft. Again in the year 1995 by virtue of a new enactment the Board was renamed as PUDA and this newly constituted authority decided to hold a draw on 1.8.1995 and for that purpose a public notice dated 25.7.1995 was published in almost all the leading news-papers.
