ORDER

Mr. Justice S.K. Dubey, President—This is an appeal under Section 15 of the Consumer Protection Act, 1986 (for short the 'Act') filed by the opposite party against the order dated 27.1.1994 passed in Case No. 7/1992 by the District Consumer Disputes Redressal Forum, Balaghat (for short the 'District Forum').

2. The legal representatives of the deceased Mohammad Jabbar, filed a complaint under Section 12 of the Act to claim compensation of Rs. 1 lac with its interest at the rate of 12% p.a. for the death caused due to negligence in treatment administered by the opposite party, a Registered Homeopathic Doctor. The deceased was suffering from gastro-enteritis disease, who came for his treatment in the hospital of the opposite party where he was admitted as indoor patient on 4.6.1992. The opposite party gave him Homeopathic Medicine Naxophemia. Thereafter, the deceased was given Allopathic system medicines that is of Glucose (Dextrone) drip and other injections. The condition of the deceased did not improve, seeing this the opposite party left the deceased and ran away from the hospital. The brother of the deceased took the deceased to Government Hospital on 6.6.1992 at about 4.00
