Thiru Justice E.J. Bellie, President—These two appeals arise out of one order passed by the District Forum, Chennai South in O.P. No. 254/ 97. They can be disposed of in one order here.
2. The case of the complainant is that M/s. Computer Consultancy Centre had purchased a Pager of No. 701229 from the opposite party on 29.11.1995 and the same was gifted to the complainant on the same day. The complainant had been paying the subscription to the opposite party. But the opposite party, without sending any written demand notice for payment of the subscription for the period from July to September, 1996, disconnected the service on 5.8.1996. The complainant paid a sum of Rs. 1,470/- on 17.8.1996 towards registration fee and subscription charges. But the opposite party instead of activating the pager service on that day i.e., 17.8.1996 itself, chose to resume the service only on 20.8.1996. The opposite party disconnecting the pager service without prior notice on 5.8.1996 and delaying in resumption of activity of the pager service amounted to deficiency in service on their part. On these grounds the complaint was filed.
