ORDER

Mr. Justice P.N. Nag, President— Admittedly, the brother of the appellant/ complainant who was driving the scooter at the time of accident, did not have the valid licence to drive the Scooter, although he was having a licence for driving L.M.V. (Light Motor Vehicle).

2. In our opinion, it is not necessary that licence for Light Motor Vehicle is valid to drive the Scooter which is a two-wheel drive. A separate licence is required to drive the Scooter and the licence for Light Motor Vehicle will not cover this case. Since the driver was not having a valid licence to drive the Scooter, it is violative of the terms and conditions of the policy and the appellant/complainant is not entitled to any relief. We are in agreement with the findings of the District Forum. No interference is called for.

3. There is no force in this appeal and is accordingly dismissed with no order as to costs.

Appeal dismissed.
