Mr. Jasbir Singh, Member—Life Insurance Corporation of India, the opposite party, challenges order of District Forum, Fatehgarh Sahib dated 31.8.1999 in this appeal under Section 15 of the Consumer Protection Act, 1986. The L.I.C. was directed to pay Rs. one lac under policy alongwith interest at the rate of 12% w.e.f. 1.2.1996 till payment. The Life Insurance Corporation has also been directed to pay Rs. 1,000/- as costs.
2. Sh. Karnail Singh, husband of Charanjit Kaur had taken one life insurance policy on his life which was numbered as 1605751 for Rs. one lac. During the subsistence of this policy Karnail Singh died on 31.10.1994 due to post renal transplant chronic renal failure and pancytopenia pneumonia. The complainant filed the claim being nominee appointed by her husband under this policy. The claim was repudiated by the opposite parties.
3. The opposite parties resisted the claim on the ground that the deceased was suffering from hypertension, abdominal pain and chronic renal failure and his left kidney was absent before taking the policy so the claim was repudiated by the L.I.C. on the ground that the deceased insured in his personal statement in the proposal form o
