Mr. Justice C.M. Nayar, Chairman—This order will dispose of an application of the Director General (Investigation and Registration) [DG] under Section 36B(c) of the Monopolies and Restrictive Trade Practices Act, 1969 (hereinafter referred to as the MRTP Act). The brief facts of the complaint are that the Company is incorporated under the Companies Act, having its office at 99, Armenian Street, Madras-600034 and inter alia engaged in the business of manufacturing and selling of chemicals and detergent powders in order to promote to sale of “Henko” detergent powder, the respondent has launched a sale promotion scheme under the caption “Sparkle with Henko Contest”. The scheme in question was advertised by the respondent in various newspapers. The applicant says that he has received a complaint dated 1.6.1994 from one Shri C.J. Subramaniam along with a copy of the advertisement released in the “Times of India” dated 29.5.1994. It is contended that the object of alluring the gullible customers for buying Henko Detergent powder has to buy 500 gms. or 1 kg. of Henko powder to participate in the scheme.
