Mr. Justice S.K. Dubey, President—This appeal is directed against the order dated 5.7.2000 passed in Case No. 32/1997 by the District Consumer Disputes Redressal Forum, Chhindwara (for short the “District Forum”).
2. Life Insurance Corporation of India (for short “LIC”) after acceptance of the proposal issued a policy No. S/67908908 for the sum assured of Rs. 50,000/- under the Salary Savings Scheme of the table and term 14-20 on 28.8.1985 of the maturity date of 28.8.2005 to the respondent, who was employed as Tub Loader in the Bhawani Incline, Ambara Colliery. He fell down from the roof at the time of loading the coal due to which he received severe injuries in the ribs and backbone. He remained under treatment for a period of 217 days. The Medical Board after examining assessed 100% disability of which certificate was issued. The appellant lodged the claim for payment of accident benefit. The LIC rejected the claim vide letter dated 21.7.1997 on two grounds that is the intimation of accident was not given to the LIC within a period of 120 days as per the policy condition and the nature of the injury sustained was not covered under condition No. 10(a) of the policy as there w
