Mr. Justice K.D. Shahi, President—This is an appeal against the order dated 22.11.2003 passed by the District Forum, Udham Singh Nagar whereby the complainant was allotted a sum of Rs. 50,000/- (Rupees fifty thousand) as compensation along with cost of litigation of Rs. 1,000/- (Rupees one thousand).
2. The brief facts of the case are that Smt. Simranjeet Kaur was pregnant. She was advised for ultra-sound by Dr. P. Kaur of Param Dharam Nursing Home, Bajpur. The complainant came to the diagnostic centre of the opposite party owned by Dr. Ranjan Sharma. He assured that all types of tests are conducted at his centre. He charged a sum of Rs. 400/- (Rupees four hundred) for the blood examination of the complainant. The report was given to the complainant on 24.1.2001 and she was reported of having AIDS. She was asked that as she was having AIDS, she cannot produce a child. She became unconscious. When her husband and family members were informed, they also suffered mental agony and distress.
