Maj. Gen. S.P. Kapoor, Member—This is an appeal filed by the complainant Sh. Kuldip Singh against impugned judgment and order dated 27.10.2004 passed by the District Consumer Disputes Redressal Forum-II, U.T., Chandigarh (for short hereinafter to be referred as District Forum) in Complaint Case No. 162 of 2004.
2. The facts of the case in brief are narrated as under:
On the basis of the registered Will of deceased Sh. Piara Singh, a commercial site bearing SCF No. 15 measuring 135.55 sq. yards for running an Atta Chakki in the suburban sector in village Dhanas, U.T., Chandigarh was transferred to the appellant/complainant vide letter No. 13290 dated 6.5.2003 (transfer deed) by the O.P. No. 2-Estate Officer, Chandigarh Administration, Estate Office, Sector 17, Chandigarh. As per the terms and conditions of the letter of allotment, the respondents/O.Ps. were required to provide all basic amenities such as street lights, parking facilities, approach road, drinking water, concrete pavements, toilets and sanitation in this locality.
