Mrs. Devinderjit Dhatt, Member—This appeal has been filed against the order dated 22.9.2004 by District Consumer Disputes Redressal Forum-II, U.T., Chandigarh (for short hereinafter to be referred as District Forum) in Complaint Case No. 433 of 2003.

2. The contextual facts in brief are as under:

The respondent/complainant entered into loan agreement, Account No. 37906 with HDFC Bank and obtained a loan of Rs. 1,85,000/- on 23.7.1993 repayable in 120 equated instalments from August, 1993 onwards. The EMI as per loan agreement signed by the parties, for the first 36 months was Rs. 2,482/-, for the next 48 months Rs. 2,854/- and Rs. 3,126/- for the last 36 months and the amount was to be paid by post-dated cheques. The main grouse of the respondent/complainant is that appellant/O.P. had asked him to deposit additional amount of Rs. 209/- on each EMI of last 36 months which is in clear violation into of the loan agreement. The respondent/complainant has alleged that appellant/O.P. has unilaterally and illegally hiked the contractual obligation to Rs. 3,335/- EMI and have demanded penal interest in an illegal and unlawful manner. The respondent/complainant is aggrieved against the d
