Mr. Justice Sunil Kumar Garg, President—This appeal under Section 15 of the Consumer Protection Act, 1986 (hereinafter referred to as “the Act of 1986”) has been filed by the appellant against the order dated 23.7.2002 passed by the learned District Forum, Baran in Case No. 72/1999 by which the complaint filed by the appellant-complainant under Section 12 of the Act of 1986 was dismissed.

It may be stated here that the complainant-appellant filed a complaint before the learned District Forum, Baran stating inter alia that on 11.7.1999, he purchased a ticket of passenger train No. 189-Down running from Kota to Baran and that train was to leave the Station at about 6.25 p.m., but that train left the station after 30 minutes and further, the train reached at the destination near about 2 hours late. It was contended by the appellant-complainant that since the train had reached at the destination with delay of about two hours, therefore, for that, he should be awarded compensation.

3. The learned District Forum, Baran through impugned order dated 23.7.2002 rejected the complaint of the appellant-complainant holding inter alia that since the delay was explained by the respondents,
