Mr. Justice R.S. Mongia, President—This is an appeal at the behest of the New India Assurance Company Ltd. against the order of the District Consumer Disputes Redressal Forum, Amritsar (hereinafter called the “District Forum”) dated February 18, 2003, by which the complaint of the complainant (respondent herein) was allowed in the following terms:

“11. The complainant has not produced any evidence to show the expenses incurred on his treatment in Sitaram Bhartia Institute of Sciences and Research. Opposite party has also not placed on record any document to show the bills, etc. produced by the complainant along with the claim. Hence, no order of specific amount paid by the opposite party can be passed. Opposite party can only be given a direction to settle the claim in accordance with rules.

12. The complaint is allowed with costs of Rs. 500. Repudiation of claim by the opposite party is set aside. Opposite party is directed to pay the claim to the complainant on consideration on the bills, etc. produced by the complainant and in accordance with rules. The compliance of this order be made within one month from the receipt of copy of order.”
