Mr. Justice R.S. Mongia, President—This is an appeal by M/s. Super Textiles, Bathinda whose complaint was dismissed by District Consumer Disputes Redressal Forum, Bathinda vide the impugned order dated 20.4.2005 primarily on the ground that the complainant is not a consumer.
2. The respondent-Punjab Small Industries and Export Corporation Ltd. (hereinafter referred to as the “Corporation”) had allotted plot No. E-37, Growth Centre, Bathinda, measuring 1,000 sq. yards to the appellant M/s. Super Textiles @ Rs. 150 per sq. yard. This was for the purpose of establishing textile industry on the plot. The allotment was made on 27.7.1998 vide allotment letter Ex. C-4. Prior to the allotment of the plot, earnest money in the sum of Rs. 15,000 was deposited by the complainant on 5.12.1994. After the allotment, the amount was payable in six bi-annual equated instalments. It so happened that the District Judge enhanced the compensation of the land on which plots were carved out and another sum of Rs. 188 per sq. yard was demanded from the complainant by the respondent-Corporation vide letter dated 7.7.2002.
