ORDER

Mr. Justice K.S. Gupta, Presiding Member—In this revision, challenge is to the order dated 15.9.2005 of Consumer Disputes Redressal Commission Jharkhand, Ranchi allowing appeal against the order dated 11.11.1993 of a District Forum and dismissing complaint as time barred. Petitioner/complainant was employed as Laboratory Asstt. with the respondent/opposite party. Certain amount was being deducted from his salary towards provident fund. Petitioner left the services of respondent on 31.3.1961. On not settling P.F. account despite letters the petitioner filed complaint before the District Forum.

2. State Commission has opined that there was delay of about 34 years in filing complaint. Relying on the letters dated 31.7.1995 (copy at page 19) and 25.8.1995 (copy at page 22) and para No. 2 of the order of District Forum the submission advanced by Ms. Pankaj Bala Varma for petitioner is that the respondent at no point of time had denied liability for payment of P.F. amount due and the complaint filed sometime in the year 1997 was within time. Said two letters are from the respondent to the petitioner and omitting immaterial portion, are reproduced below:
