Mr. T.P. Gupta, Member—This appeal has been filed by the appellant under Section 15 of the Consumer Protection Act, 1986 against the order dated 27.8.1997 passed by the learned District Forum, Udaipur whereby the complaint of the complainant-appellant was dismissed.

In this case the appellant had filed a complaint in the Forum below stating that his younger brother Pramod Kumar Pradhan, aged 15 years, had taken Membership under ULIP Scheme on 16.8.1989 for a period of 15 years. Thereafter, he had deposited half-yearly instalments of Rs. 1000 in time. Unfortunately, the said Pramod Kumar Pradhan died on 8.1.1994 and the complainant filed a claim with the respondent on 23.3.1994 but as the claim was not settled by the respondent, he filed the complaint in the Forum below on 19.8.1996 claiming the benefits under ULIP scheme, Rs. 10,000 as damages on account of mental agony, Rs. 500 as postal charges, and Rs. 500 as cost of litigation.
3. The respondent replied that there were certain objections on the claim which were communicated to the appellant on 19.11.1994 but the same were not removed in spite of reminders sent to the appellant on 8.3.1995 and 17.4.1996. Thereafter Chief R
