ORDER

S.A. Kader, President - This is a complaint under Section 17 read with Section 12 of the Consumer Protection Act.

2. The complainant was a constituent of the opposite party Central Bank, Nungambakkam Branch and was having an account with the opposite party in the name of K.T.K. Films. She had deposited with the opposite party to the tune of Rs. 50,00,000/-. She applied for and availed of overdraft facilities from the opposite party on the security of her deposit and on the deposit of her title deeds pertaining to some immovable property at Cochin as security. The complainant's husband Mr. K.T. Kunjumon had also deposited with the opposite party and had also availed of overdraft facilities on the security of the immovable property of the complainant. Both the overdraft accounts of the complainant and her husband were settled by payment of principal and interest between August and November 1993. According to the complainant, the opposite party had collected excessive interest and promised to repay the same. The opposite party was entitled to collect interest only at 11 % but it has collected interest at higher rate. It has also failed to adjust the deposit a amounts on the date o
