ORDER

D.R. Vithal Rao, President - In this Complaint, under Sec. 17 read with Sec. 12 of the Act, the complainant has sought compensation in a sum of Rs. 7,10,000/- from the opp.party, the Insurance Company Limited.

2. The complainant had Raisin Manufacturing Unit in Hanumasagara village of Gundadal Post, Bijapur District. The complainant insured plant and machinery and the stock of grapes, chemicals and other articles with opp.party under Fire Policy, Ex.C-1, the duration of which was from 22-2-1989 to 21-2-1990. The insured amount was Rs. 5,68,000/-.

It is the case of the complainant that in the early hours of 12-8-1989, the fire accident took place in the said unit and the entire assets contained therein, six tones of dried grapes, nylon nets and other materials got burnt and destroyed.

The complainant immediately made a report of the occurrence to the police as per Ex. C-9. The police on receipt of the said complaint, recorded a mahazar as per Ex. C-10. The complainant also informed the occurrence to the opp. party by a telegram. The opp. party, the Manager along with Development Officer visited the said factory premises on 13-8-1989 and inspected the factory premises.
