A. Venkatarami Reddy, President Although the complainants m these two CDs. are different, the opposite party is the same. The allegations made in the complaints and the pleas taken in the counters filed by the opposite party, the evidence adduced, the contentions raised, and the questions that fall for determination in both the complaints are substantially the same, hence they are being disposed of by a common order.
2. The complainant in CO. No. 21/90 raised Eucalyptus plantation in the extent of Ac. 10.32cents in S.No. 32, Ac. 23. 26 cents in S. No. 237, Ac. 5.61 cents in S. No. 338, Ac. 3.00 in S. No. 310 situated in Chinna Annalur village of Kaligiri Mandai, Mellore Dist. and Ac. 1.81 cents in S. No. 61/2 situated in East Jangalapalli of Kondapuram Mandai, Nellore District. The complainant obtained a loan from Indian Bank,( Mogalrajupuram Branch, Vijayawada for raising I the said plantation. When the plantation was about 5-1/2 years old, the complainant insured t the said plantation in the above extent land ,f through her banker, with the opposite party i.e. It United India Insurance Company Ltd., on e 7.6.1989 for a sum of Rs. 2,20,000/- covering d the period from 7.
