Gurmit Mahal claims compensation of Rs. 10 lacs against Chauhan Nursing Home. opposite party No. 1 as well as Dr. Niraj Aggarwal, opposite party No.2 on account of loss suffered due to negligent act of the opposite parties in the matter of removal of Gall Bladder by cutting the Common Bile Duct resulting in complications and further hospitalisation in the PGI, Chandigarh for months together.
2. Lt. Col. J.P. Singh, husband of the complainant is in the Army and when the complainant suffered pain in the stomach, she was examined at the Military Hospital. Some tests were held. It was opined that there were stones in t he Gall Bladder. The complainant and her husband approached Chauhan Nursing Home, opposite party No. 1 where again tests were held and it was confirmed that there were stones in the Gall Bladder, which were required to be removed. It was proclaimed that Dr. Niraj Agarwal was a competent. Surgeon having experience of performing about 600 laproscopic operations without a single complication.
